1. Overview

This Privacy Policy explains how DUO Marketplace LLC collects, uses, shares, stores, and protects information related to Swamp Creature™.

We built Swamp Creature™ around a simple principle: your prospecting activity should be treated like private business work, not like advertising inventory. We do not sell your Hunt data, search criteria, prospecting results, or account information to third parties.

This policy applies to Swamp Creature™ websites, applications, subscriptions, credit purchases, free trials, support interactions, and related services.

2. Information We Collect

Account information may include name, business name, email address, phone number if provided, login credentials, account settings, subscription status, user role or permissions, and support communications.

Billing and payment information may include billing name, billing email, billing address, subscription plan, purchase history, credit purchases, invoices, payment status, and tax information where required. Payment card details may be collected and processed directly by our payment processor.

Service usage information may include login activity, features used, credits consumed, searches started or completed, error logs, device and browser information, IP address, approximate location based on IP address, pages viewed, date and time of activity, referral or campaign source, and performance or diagnostic data.

Hunt data and generated results may include target industries, geographic areas, keywords, exclusions, custom search instructions, prospecting preferences, generated business leads, business names, websites, contact routes, categories, scores, notes, and related result fields.

3. How We Use Information

We may use information to create and manage accounts, provide Swamp Creature™ features, process subscriptions and payments, run searches and generate results, track credits and usage, provide support, troubleshoot errors, secure the service, detect fraud or misuse, enforce our Terms, improve reliability, develop new features, send service notices, send optional marketing where permitted, and comply with legal obligations.

We treat Hunt data and generated prospecting results as private account information. We do not sell it. We do not use it to market third-party products to you.

4. Service Emails vs. Marketing Emails

Some emails are necessary to provide Swamp Creature™, including account creation, password reset, security alerts, billing notices, payment failure notices, subscription changes, credit purchase confirmations, low-credit alerts, important service updates, legal changes, support responses, and compliance or misuse notices.

Marketing messages are different. These may include promotions, product announcements, upgrade offers, newsletters, educational campaigns, or information about other DUO products or services.

You may opt out of marketing emails at any time by using the unsubscribe link or contacting us. Opting out of marketing emails does not stop necessary service, billing, account, security, or legal notices.

5. How We Share Information

We may share information with service providers that help operate Swamp Creature™, including hosting providers, cloud infrastructure providers, payment processors, email providers, analytics tools, support systems, AI providers, security tools, and other operational vendors.

We may disclose information for legal, safety, and compliance purposes if reasonably necessary to comply with law, enforce our Terms, investigate fraud, abuse, spam, illegal activity, security threats, or misuse, or protect Swamp Creature™, DUO, users, vendors, or the public.

If we are involved in a merger, acquisition, financing, sale of assets, reorganization, bankruptcy, or similar business transaction, information may be transferred as part of that transaction, subject to appropriate protections where required.

6. What We Do Not Do

We do not sell your Hunt data or prospecting results.

We do not sell your account information to third-party marketers.

We do not use your private Hunt data or prospecting results to market third-party products to you.

We do not intentionally collect sensitive personal information such as Social Security numbers, government ID numbers, financial account passwords, health information, biometric information, children's information, or precise geolocation through normal account setup.

7. Cookies and Similar Technologies

We may use cookies, pixels, local storage, or similar technologies to keep you logged in, remember preferences, secure the service, analyze usage, improve performance, and understand how users interact with our website.

We may also use cookies or similar tools for marketing or analytics where permitted. If required by law, we will provide cookie notices or consent controls.

8. Data Retention

We keep information only as long as reasonably necessary for the purposes described in this Privacy Policy, unless a longer retention period is required or permitted by law.

Retention periods may vary depending on information type, account status, subscription status, legal obligations, security needs, backup cycles, tax and accounting requirements, dispute resolution, fraud prevention, and operational needs.

Account and billing records may be retained while the account is active and as needed for tax, accounting, legal, and business records. Hunt inputs and generated results may be retained according to account settings, export history, plan rules, or user deletion controls. Security logs may be retained for a limited period necessary to protect the service.

9. Security and Your Choices

We use reasonable safeguards designed to protect information from unauthorized access, misuse, loss, alteration, or disclosure. No internet-based service can be guaranteed completely secure.

Depending on where you live, you may have rights to request access to, correction of, deletion of, or a copy of certain personal information. You may also have the right to object to or limit certain processing, opt out of certain sharing, or appeal a decision we make about your request.

We may need to verify your identity before completing certain requests. Some information may be retained where allowed or required by law, including for security, fraud prevention, tax, accounting, legal, dispute, or legitimate business purposes.

10. State Privacy Rights, Children, International Users, Changes, and Contact

Some states provide residents with specific privacy rights. If applicable to our business, we will provide required notices, disclosures, and request mechanisms. We do not intend to sell personal information. If our practices change, we will update this Privacy Policy and provide required opt-out mechanisms.

Swamp Creature™ is intended for business users who are at least 18 years old. We do not knowingly collect personal information from children under 13.

We may update this Privacy Policy from time to time. Questions or privacy requests may be sent to the contact listed in the final published version.

Plain-English promise: Swamp Creature™ is built for business prospecting, not creepy data games. Your Hunts, Digs, search criteria, and prospecting results are treated as private account information. We do not sell your Hunt data or prospecting results, and we do not use them to market third-party products to you.
