Terms and Conditions

These Terms and Conditions govern your access to and use of Swamp Creature™, including our website, application, subscription plans, credit-based features, AI-enhanced prospecting tools, reports, exports, and related services.

By creating an account, purchasing credits, starting a free trial, subscribing to a paid plan, or otherwise using Swamp Creature™, you agree to these Terms. If you do not agree, you may not use the service.

We may update these Terms from time to time. If we make material changes, we may notify you by email, in-app notice, website notice, or another reasonable method. Your continued use after updated Terms become effective means you accept the updated Terms.

Swamp Creature™ is an AI-enhanced prospecting engine designed to help users search for, identify, organize, evaluate, and export business prospecting information based on user-selected criteria.

Features may include Hunts and Digs, AI-assisted lead discovery and enrichment, prospect scoring, filtering, business contact and website analysis, exportable results, usage credits, subscription tools, account features, billing features, administrative features, and future DUO software add-ons.

Swamp Creature™ is intended for lawful business prospecting and research only. It is not a tool for harassment, illegal scraping, spam, fraud, deceptive outreach, surveillance, discrimination, or other prohibited use.

You must be at least 18 years old and legally able to enter into a binding agreement to use Swamp Creature™.

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

You agree to provide accurate account, billing, and contact information and to keep it current. We may suspend or terminate accounts that contain false, misleading, incomplete, or outdated information, or that are used in violation of these Terms.

Swamp Creature™ may be offered through free trials, paid subscriptions, credit packages, usage-based pricing, promotional offers, or other pricing models.

By purchasing a subscription or credits, you authorize us and our payment processors to charge your selected payment method for applicable fees, taxes, renewals, upgrades, and other charges you approve.

Unless stated otherwise at checkout, subscription fees are billed in advance, subscriptions automatically renew until canceled, credits may be consumed when you run searches or premium features, and promotional or courtesy credits may have separate limits or expiration rules.

Each email address may receive one free trial. Trial extensions, bonus credits, and courtesy credits may be limited or unavailable depending on account standing and plan rules.

Unless otherwise stated in writing, all payments are non-refundable except where required by law.

We want the system to be fair. At our discretion, we may issue credit adjustments, refunds, replacement credits, or account credits where a search fails, duplicate records are detected, system errors occur, or results do not meet the minimum usable-output standard we define for the service.

Credit adjustments are not guaranteed and may be limited to specific plan types, error types, or account standing.

You agree to use Swamp Creature™ only for lawful, ethical, and legitimate business purposes.

You may not use Swamp Creature™ to violate law, send spam or deceptive outreach, harass or threaten anyone, target people or businesses using illegal or discriminatory criteria, collect or use personal information unlawfully, impersonate another person or company, misrepresent your identity or intent, scrape or harvest data where prohibited, upload unlawful or offensive content, run phishing or malware activity, reverse engineer the service, bypass limits or billing controls, disrupt the service, use unauthorized bots against Swamp Creature™, build a competing product, or damage DUO, Swamp Creature™, our users, vendors, or the public.

We reserve the right to investigate suspected misuse and to suspend, restrict, block, or terminate access where we believe these Terms have been violated.

Swamp Creature™ may help you identify business prospects, but you are solely responsible for how you use prospect information after receiving it.

You are responsible for complying with all laws and rules that apply to your outreach, marketing, sales, data handling, recordkeeping, and communications, including applicable email, SMS, telemarketing, privacy, consumer protection, and advertising laws.

This includes requirements related to accurate sender identity, honest subject lines and message content, proper opt-out or unsubscribe options, honoring opt-out requests, avoiding deceptive claims, maintaining suppression lists, respecting source restrictions, and using data only for lawful business purposes.

Swamp Creature™ uses AI and automated systems to help search, classify, summarize, enrich, score, and organize prospecting information.

AI-assisted results may be incomplete, outdated, inaccurate, duplicated, misclassified, or unsuitable for your specific purpose. Swamp Creature™ does not guarantee that any prospect, score, contact route, business category, recommendation, summary, or output is accurate, complete, current, lawful to use, or appropriate for your business.

You are responsible for reviewing and verifying results before relying on them or contacting any prospect.

You may submit search criteria, business targets, geography, keywords, exclusions, custom instructions, uploaded information, or other inputs into Swamp Creature™. These may be referred to as Hunt data, Dig data, search criteria, user inputs, or similar terms.

Your Hunt data and generated prospecting results are treated as private account information. We do not sell your Hunt data or prospecting results. We do not use your Hunt data or prospecting results to market third-party products to you.

We do not actively review your Hunt data or prospecting results except as reasonably necessary to provide, operate, maintain, or improve the service; troubleshoot bugs or support tickets; prevent fraud, abuse, illegal use, or security threats; enforce these Terms; comply with legal obligations; or protect Swamp Creature™, DUO, our users, vendors, or the public.

Swamp Creature™, including its software, systems, workflows, prompts, designs, branding, scoring logic, interfaces, documentation, databases, code, names, logos, and related intellectual property, is owned by DUO Marketplace LLC or its licensors.

You receive a limited, revocable, non-exclusive, non-transferable right to use Swamp Creature™ according to these Terms and your active plan. You retain rights you have in your lawful inputs and may use prospecting outputs generated for your account for your internal business purposes.

If you send feedback, ideas, suggestions, feature requests, or improvements, you agree that we may use them without restriction or compensation.

Swamp Creature™ may rely on third-party providers, websites, APIs, payment processors, hosting providers, AI providers, email systems, analytics tools, data sources, or integrations.

We are not responsible for third-party websites, services, policies, data accuracy, availability, outages, changes, restrictions, or terms. Your use of third-party services may be governed by their own terms and privacy policies.

Prospecting results may be based on publicly available business information, user-provided inputs, third-party data, automated analysis, and other sources. We do not guarantee that third-party information is accurate, current, complete, or lawful for your intended use.

We may modify, update, suspend, limit, replace, or discontinue any part of Swamp Creature™ at any time. We may add or remove features, change plan limits, adjust credit rules, update scoring logic, modify data sources, or change how results are generated.

We may suspend, restrict, block, or terminate your account or access if we believe you violated these Terms, used the service for illegal or harmful purposes, created security or legal risk, failed to pay required fees, bypassed plan limits, or if we are required to do so by law, court order, vendor restriction, or government request.

Termination may result in loss of access to your account, credits, exports, settings, history, and related data, subject to our retention practices and legal obligations.

We use reasonable administrative, technical, and organizational safeguards designed to protect account information and service data. No system is completely secure. You are responsible for using strong passwords and protecting your credentials.

Swamp Creature™ is provided on an as-is and as-available basis. To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, and reliability.

To the fullest extent permitted by law, we will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost revenue, lost business opportunities, lost data, reputational harm, or business interruption. Our total liability for a claim related to Swamp Creature™ will not exceed the amount you paid during the three months before the event giving rise to the claim, or $100 if you did not pay us during that period.

You agree to defend, indemnify, and hold harmless DUO Marketplace LLC, its owners, officers, employees, contractors, affiliates, vendors, and agents from claims arising from your use or misuse of Swamp Creature™, violation of these Terms, outreach or use of results, violation of law or third-party rights, submitted inputs, fraud, misrepresentation, negligence, or willful misconduct.

We may preserve, access, disclose, or share account information, service data, or related records when reasonably necessary to comply with law, enforce these Terms, investigate fraud or misuse, or protect Swamp Creature™, DUO, users, vendors, or the public.
